Applying for a K-1 visa Requirements

.You must be a USA citizen.  Lawful permanent resident. “Green card’’ holder of the United States are not allowed to obtain Fiancée visas.

You must be able to prove that you are ready, willing and legally able to marry.  This means that if either of you have been married previously, you are either divorced, widowed.

You must meet your Fiancée in Person within the previous two years and you must show the existence of the serious relationship between you and her.  In addition you must prove that you and your fiancée have met face to face at some point within the last two years. The proof of the meeting can consist of passport Photos of you and her  and the receipt, Hotel receipt, Plane ticket stubs, Photos of you and her with you arm around your fiancée. 

You must marry your fiancée within 3 months of when she arrived into the U.S. and file the change of statutes.  If you do not,  she will have to go back to the Philippines.

The petitioner must also meet certain income requirements, normally 125 percent over the poverty level (click here).  So for the Family of 2 you will have to make 18,000 dollars a year.

There are also change of statutes for your 2 year green card, which are part of the Homeland Security Act, which pertains to K-1 visas that you need to be aware of.  The change of statutes is for your 2 year residency card now this card is only a trial card.  You have to file for her 10 year residency card and another interview.
